DMCA Policy

1. Commitment to Intellectual Property

bah.is respects the intellectual property rights of others and expects its users to do the same. This policy outlines the procedures for reporting copyright infringement and for responding to takedown notices under the Digital Millennium Copyright Act (17 U.S.C. § 512).

2. Reporting Copyright Infringement

If you believe that copyrighted material has been made accessible through our Services in a way that constitutes copyright infringement, you may submit a DMCA takedown notice containing the following information:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
2. A description of the copyrighted work claimed to have been infringed
3. The specific bah.is short link URL(s) that allegedly infringe upon or link to infringing material
4. Your contact information: full name, mailing address, telephone number, and email address
5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner

3. DMCA Designated Agent

4. Processing Takedown Notices

Upon receiving a valid DMCA takedown notice, bah.is will:

1. Review the notice for compliance with statutory requirements
2. Expeditiously disable the allegedly infringing short link(s)
3. Notify the account holder whose link was disabled, providing a copy of the notice
4. Inform the account holder of their right to submit a counter-notice

5. Counter-Notice

If you believe your link was disabled as a result of mistake or misidentification, you may submit a counter-notice to legal@bah.is containing:

1. Your physical or electronic signature
2. Identification of the material that was removed or disabled and the URL at which it appeared before removal
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
4. Your full name, mailing address, and telephone number
5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the federal courts in San Diego, California)
6. A statement that you will accept service of process from the person who provided the original DMCA notice (or their agent)

6. Counter-Notice Processing

Upon receiving a valid counter-notice, bah.is will:

1. Forward the counter-notice to the original complainant
2. Inform the complainant that the disabled link will be restored in 10 business days unless the complainant files a court action seeking a restraining order
3. Restore the link after 10-14 business days if no court action is filed

7. Repeat Infringers

bah.is maintains a policy of terminating the accounts of users who are repeat copyright infringers in appropriate circumstances. Factors considered include the number of valid DMCA notices received, the nature of the infringement, and whether the user has submitted valid counter-notices.

8. Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorney fees.
