Terms of Service

1. Acceptance and Consent

bah.is ("Necati Atahan," "we," "our," "us") is a platform offering URL shortening, link management, QR code generation, and analytics services (collectively, the "Services"). These Terms of Service ("Agreement") govern your access to and use of the Services and constitute a binding legal agreement between you and bah.is.

1.1 Consent at Registration

During account creation, you must provide the following affirmative consents:

• Required: Active checkbox confirming you have read and agree to the Terms of Service and Privacy Policy
• Required: Separate acknowledgment of data collection practices
• Required: Notice that dispute resolution is subject to binding arbitration and class-action waiver
• Optional: Separate opt-in consent for marketing communications

If you do not accept this Agreement, you may not access or use the Services.

1.2 Age Requirement

You must be at least 18 years old or authorized to represent an organization to use the Services. Users under 18 may not create accounts or use the Services.

2. Account and Registration

2.1 Account Creation

You may need to create an account to use certain features of the Services. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

2.2 Account Security

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at legal@bah.is upon becoming aware of any unauthorized access.

2.3 One Account Rule

Each individual may create only one account. If multiple accounts belonging to the same individual are detected, bah.is reserves the right to suspend or close all associated accounts.

2.4 Organizational Accounts

If you create an account on behalf of an organization, you represent and warrant that you have authority to bind that organization to this Agreement.

3. Services and Usage

3.1 Scope of Services

bah.is offers the following services:

• URL shortening and custom short link creation
• QR code generation
• Link management and editing
• Click analytics and reporting
• API access (on eligible plans, subject to the API Terms)

3.2 Link Permanence

bah.is aims to keep created short links operational for a reasonable period. However, links may be disabled in the following circumstances:

• Violation of the Acceptable Use Policy
• Legal obligation or law enforcement request
• Account termination or closure
• Complete discontinuation of the Services

If advertisements or redirect changes are applied to free-tier links, users will be notified at least 30 days in advance.

3.3 Fair Use

The free plan is intended for reasonable personal and small-scale commercial use. If excessive or automated bulk usage is detected, bah.is may require an upgrade to a paid plan or restrict access.

3.4 Service Modifications

bah.is reserves the right to modify, suspend, or discontinue any part of the Services at any time. For material changes affecting paid users, we will provide at least 30 days' notice.

4. User Responsibilities

4.1 Content Responsibility

Users are solely responsible for all links they create, the destination content those links point to, and any consequences arising from sharing those links.

4.2 Compliance

You agree to use the Services in compliance with all applicable laws, regulations, and the bah.is Acceptable Use Policy.

4.3 Prohibited Uses

Users may not use the platform for phishing, malware distribution, scams, impersonation, illegal gambling, drug trafficking, harassment, copyright infringement, bot traffic manipulation, or any other activity prohibited by the Acceptable Use Policy.

5. Fees and Payment

5.1 Paid Plans

Fees for paid plans are listed on the relevant plan page. All fees are in US Dollars unless otherwise stated.

5.2 Billing

Paid plans automatically renew according to the selected billing cycle (monthly or annual). You authorize us to charge your payment method on file for recurring fees.

5.3 Refunds

Refund eligibility is governed by our Refund Policy. Unless otherwise specified, all fees paid are non-refundable.

5.4 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the start of the next billing cycle.

5.5 Late Payment

If payment fails, we may suspend access to paid features after providing reasonable notice and an opportunity to update your payment method.

6. Intellectual Property

6.1 bah.is Ownership

The Services, software, design, trademarks, documentation, and related intellectual property rights belong to bah.is or its licensors. Nothing in this Agreement grants you any right to use our trademarks or branding without prior written consent.

6.2 User Content

All rights and responsibilities for the short links you create and the content at destination URLs remain with you.

6.3 License to bah.is

You grant bah.is a limited, non-exclusive, worldwide, royalty-free license to process, display, and transmit your user content solely to the extent necessary to provide the Services.

6.4 Feedback

If you provide feedback, suggestions, or ideas about the Services, you grant bah.is a perpetual, irrevocable license to use such feedback without obligation to you.

7. Limitation of Liability

7.1 Disclaimer of Warranties

The Services are provided "as is" and "as available." bah.is makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 Liability Cap

The total aggregate liability of bah.is for any claims arising under or related to this Agreement shall not exceed the total amount you paid to bah.is in the 12 months preceding the event giving rise to the claim.

7.3 Indirect Damages

In no event shall bah.is be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.

7.4 Platform Content

bah.is assumes no responsibility for the content, accuracy, safety, legality, or availability of websites targeted by shortened URLs. Clicking a bah.is short link is done at the user's own risk.

7.5 Force Majeure

bah.is shall not be liable for service interruptions caused by events beyond its reasonable control, including but not limited to natural disasters, war, pandemics, infrastructure failures, cyberattacks, or government actions.

8. Indemnification

You agree to indemnify, defend, and hold harmless bah.is, its officers, directors, employees, and agents from and against all claims, actions, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

• Your use of the Services for unlawful purposes
• Your violation of this Agreement or the Acceptable Use Policy
• Your publication of content that infringes third-party rights
• Destination URLs containing harmful or illegal content
• Your violation of any applicable law or regulation

This indemnification obligation does not cover situations arising from the gross negligence or willful misconduct of bah.is.

9. Dispute Resolution and Arbitration

9.1 Informal Resolution Process

In the event of any dispute arising out of or relating to this Agreement or the Services, the parties will first attempt to resolve the matter informally in good faith for a period of 60 days. This process begins with written notice sent to legal@bah.is.

9.2 Binding Arbitration

If the informal resolution process does not resolve the dispute, it shall be resolved through binding arbitration under the Federal Arbitration Act (FAA). Arbitration rules:

• Arbitration shall be conducted on an individual basis
• The language of arbitration shall be English
• The seat of arbitration shall be San Diego, California
• The arbitrator's decision shall be final and binding

9.3 Small Claims Exception

Either party retains the right to bring an individual action in a small claims court of competent jurisdiction, provided the claim falls within the court's jurisdictional limits.

9.4 Intellectual Property and Emergencies

For intellectual property infringement, confidentiality breaches, and data security emergencies, either party retains the right to seek injunctive or other equitable relief from a court of competent jurisdiction without first engaging in arbitration.

9.5 Class Action Waiver

All disputes will be resolved on an individual basis. Both parties waive any right to participate in class actions, collective arbitration, or representative proceedings.

9.6 Arbitration Costs

Each party bears its own attorney fees. Arbitration filing fees are allocated according to the applicable arbitration rules.

9.7 Arbitration Opt-Out

You may opt out of the arbitration provision by sending written notice to legal@bah.is within 30 days of account creation. Your notice must include your full name, account email address, and a clear statement that you wish to opt out of arbitration.

9.8 Mass Arbitration Protocol

If more than 25 individual arbitration demands raising substantially similar claims are filed within a 60-day period, a mass arbitration protocol will apply and demands will be processed in batches of no more than 10 at a time.

9.9 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.

9.10 Jurisdiction

For any matters not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.

10. Termination

10.1 Termination by User

You may close your account at any time through your account settings or by contacting legal@bah.is. Account closure does not eliminate fees accrued prior to the termination date.

10.2 Suspension and Termination by bah.is

bah.is may suspend or terminate your account immediately if you violate this Agreement, the Acceptable Use Policy, or any applicable law. bah.is may also suspend accounts that pose security risks to the platform or other users.

10.3 Post-Termination Data Handling

Upon termination:

• Your access to the Services will cease immediately
• Account data will be processed according to the retention schedule in the Privacy Policy
• Billing records will be retained as required by law
• Your short links will cease to resolve

10.4 Effect on Short Links

Upon account termination, short links created under your account will be deactivated. bah.is is not obligated to maintain redirect functionality for deactivated links.

11. Modifications to Terms

We reserve the right to modify this Agreement at any time. For material changes:

• A notification will be sent to the email address registered to your account
• Changes will be announced at least 14 days in advance
• The updated Terms will be posted on our website with a revised effective date
• Your continued use of the Services after the effective date constitutes acceptance of the updated terms
• If you disagree with the changes, you may terminate your account before the effective date

12. General Provisions

12.1 Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.2 Waiver

The failure of bah.is to enforce any provision of this Agreement shall not be construed as a waiver of such right.

12.3 Assignment

You may not assign or transfer this Agreement without the prior written consent of bah.is. bah.is may assign this Agreement without restriction, including in connection with a merger, acquisition, or sale of assets.

12.4 Entire Agreement

This Agreement, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy, DMCA Policy, API Terms (if applicable), Service Level Agreement (if applicable), Refund Policy, and Data Processing Addendum (if applicable), constitutes the entire agreement between the parties.

12.5 Survival

Provisions that by their nature should survive termination or expiration — including limitation of liability, indemnification, arbitration, intellectual property, and dispute resolution — shall continue in full force and effect.

12.6 Notices

All legal notices to bah.is must be sent to legal@bah.is. Notices to you will be sent to the email address associated with your account.
